Abstract
최근 온라인 플랫폼 시장이 급격히 성장하며, 소비자의 비합리적인 선택을 유도하는 다크패턴(눈속임설계) 사례가 늘어나고 있다. 이러한 다크패턴은 사용자의 선택을 조종하고 개인정보를 동의 없이 수집하는 위험을 초래한다. 이러한 위협에 대응하기 위해, 이제는 개인정보 보호의 관점에서 정보주체의 권리 보장을 포함하는 새로운 방안들을 모색해야 할 시기이다. 본 연구에서는 개인정보 보호와 소비자 신뢰 수준 개선 차원에서 다크패턴 방지 프레임워크를 제안한다. 이에 본 연구는 개인정보 다크패턴을 7개 유형과 12개 세부유형으로 재정의하고, 회사와 사용자 간 신뢰를 구축할 수 있는 새로운 프레임워크를 제안함으로써 사회적 차원에서의 개인정보 보호인식 제고를 목표한다. 이를 통하여 개인정보 다크패턴에 대한 학술적 연구를 확장하고, 온라인에서 발생할 수 있는 개인정보 다크패턴 방지 프레임워크를 제안하여 효과적인 개인정보 보호방책도 제공하고자 한다.
Recently, as the online platform market has grown rapidly, the number of cases of dark patterns (deceptive designs) that induce consumers to make irrational choices is increasing. These dark patterns pose a risk of manipulating users’ choices online and collecting personal information without permission. In response to these threats, it is time for new measures from the perspective of personal information protection, including guaranteeing the rights of information subjects. In this study, we propose a framework that can prevent dark patterns to improve the level of personal information protection and consumer trust. We aim to raise awareness of personal information protection in society by redefining personal information dark patterns classified into 7 types and 12 detailed types and suggesting a new framework to build trust between companies and users. Through this, we expect to be able to expand research on personal information dark patterns academically and provide effective personal information protection measures by proposing a framework to prevent personal information dark patterns that can occur online in practice.
